Thank you for choosing Smoke and Silk. By using our website, booking services, or purchasing a tailored suit from us, you agree to the following Terms and Conditions. Please read them carefully. If you do not agree with any part of these Terms, you should not use our services.

1. General Information

Smoke and Silk is a sole trader business that specializes in offering custom-tailored suits. Our suits are designed and manufactured in China based on measurements taken during your consultation in New Zealand. Finished garments are delivered directly to your nominated address.

2. Suit Orders

Design & Fitting Consultation: After booking a fitting you will receive a personal fitting consultation, either in person at a location selected by you or virtually. Both options will take place on an available time and day from Smoke & Silk’s booking system also selected by you. The measurements and design specifications recorded during this consultation will form the basis of your made-to-measure garment.

Production & Delivery: Once measurements and design are finalised, your garment will be manufactured overseas and shipped to your address. Standard production and delivery time is 5–8 weeks, with additional time required for rural deliveries or customs processing.

3. Pricing & Payment

Pricing: All prices are listed in New Zealand Dollars (NZD). Prices may be listed on our website or provided by quotation during consultation.

Payment: Full payment is required at the time of order. Payments are accepted by card via secure processing.

4. Order Modifications and Cancellations

Cancellations: Once your order has been confirmed and production has commenced, cancellations are not accepted.

Modifications: Requests to modify design, measurements, or delivery details after order confirmation are not guaranteed. However, we will try to accommodate reasonable requests where feasible.

5. Shipping & Delivery

Courier Delivery: Orders are delivered via tracked courier and shipping costs are included in your purchase price.

Delays: We are not liable for delays resulting from third-party courier services, customs clearance, or other events beyond our reasonable control. Delivery dates are indicative only and not guaranteed unless explicitly confirmed in writing.

6. Returns, Exchanges, and Refunds

Suit Quality: All garments are inspected prior to dispatch. If you receive a garment that is damaged or defective on arrival, please contact us within 30 days to request a remedy, which may include a replacement, repair, or refund in accordance with your rights under the Consumer Guarantees Act 1993.

Fit and Adjustments: Each suit is made based on the measurements taken during consultation. Minor variations in fit may arise due to fabric characteristics and the bespoke nature of tailoring. We do not accept returns due to dissatisfaction with fit unless there has been a demonstrable error in measurement or craftmanship.

We are not responsible for fit issues resulting from changes in body shape after measurements are taken, failure to provide accurate or complete information, or failure to allow adequate lead time for your order.

7. Customer Responsibilities

Accurate Information: You are responsible for providing accurate and complete information, including correct personal and delivery details. We are not liable for any issues arising from inaccuracies provided by you.

Order Timing: It is your responsibility to place your order with sufficient lead time to account for the standard production and delivery timeframe (typically 5–8 weeks), as well as any unforeseen issues that may arise during the process. If you require your garment by a specific date or for a specific occasion, you must independently assess the timing risk and place your order as early as needed to accommodate potential delays or adjustment needs. We do not guarantee delivery by any particular date unless expressly confirmed by us in writing.

8. Reasonable Use and Wear

Our garments are custom-made to your measurements and specifications for ordinary wear under normal conditions. By placing an order, you acknowledge that:

(a) Garments should be worn in a manner consistent with the nature and intended use of tailored clothing.

(b) Undue stress placed on seams or fabric — including but not limited to excessive stretching, forceful movement, or other strenuous activity — may result in damage not covered by our quality guarantee; and

(c) We are not responsible for damage arising from misuse, improper care, or unreasonable treatment of the garments, including damage caused after delivery.

Nothing in this clause limits your rights under the Consumer Guarantees Act 1993. However, where damage results from improper or excessive use, your right to a remedy may be limited under that Act.

9. Intellectual Property

All content, images, logos, and materials on our website and in our communications are the property of Smoke and Silk. You may not use, reproduce, or distribute any of our materials without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

(a) We are not liable for indirect, special, incidental, or consequential losses, including but not limited to loss of enjoyment, inconvenience, emotional distress, or non-financial loss.

(b) All delivery timeframes are indicative only and may be affected by courier delays, customs processing, or other events outside our control. Unless expressly confirmed by us in writing, delivery dates are not guaranteed.

(c) You are solely responsible for placing your order with adequate lead time to allow for production, shipping, and any necessary adjustments. We strongly recommend ordering no less than 8 weeks before the intended use to avoid potential delay-related issues.

(d) We are not responsible for dissatisfaction or fit issues caused by changes to your body measurements after consultation, or by inaccurate or incomplete information provided by you.

Nothing in this clause limits your rights under the Consumer Guarantees Act 1993.

11. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts for any dispute relating to our services.

12. Privacy Policy

13. Amendments

We may update these Terms at any time. Any changes will be published on our website and take effect immediately. We encourage you to check this page regularly to remain informed.
